By browsing, interacting with, using our Customily customisation software, or purchasing from our store, you agree to comply with and be bound by the following terms, conditions, policies, and privacy disclosures.

PART I: TERMS AND CONDITIONS

1. Online Store Terms & Eligibility

• Age Requirements: By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence.
• Lawful Use: You may not use our products, software, or high-concept designs for any illegal or unauthorized purpose.
• Service Refusal: We reserve the right to refuse service or cancel orders to anyone for any reason at any time.

2. Premium Product Disclaimers & Design Authenticity

• Visual Representation: We utilize high-detail printing to replicate advanced design elements, including organic 3D wrinkling, translucent permanent marker textures, and simulated "dog-ear" peeled sticker corners on our "Beacon" designs.
• Texture & Variance: Because our products use premium Avallon All Caps SVG fonts to mimic real marker ink with grit and transparency, physical garments may feature natural, intentional texturing that is not a printing defect.
• Color Accuracy: We strive to display product colors as accurately as possible. We cannot guarantee that your monitor or phone screen will perfectly reflect the exact shade of the AS Colour 5001T mid-heavyweight blanks.
• Pricing & Availability: Standard retail pricing is set at $38.00 USD / $52.06 CAD and is subject to change without notice. We reserve the right to limit or modify product availability at our sole discretion.

3. Customily Personalisation Software & User-Generated Content (UGC)

• Customily Engine: We use Customily software to allow real-time customisation of text and imagery on our apparel. You are entirely responsible for the specific text, words, phrases, or graphics you input or upload via the Customily application.
• No Brand Endorsement: The generation or automated rendering of a customized product preview via Customily does NOT constitute an endorsement, approval, or validation by Hello Fellow Tees of the user’s submitted content or layout. Every custom shirt is printed on an independent, automated basis.
• High-Volume & Filtering Disclaimer: While we deploy text filters and human auditing tools to actively monitor and stop inappropriate, offensive, or infringing text and shirts from being processed, Hello Fellow Tees processes a high volume of automated print-on-demand orders. Certain inappropriate or offensive phrases may inadvertently slip through our verification criteria. We assume absolutely no liability for printing content that violates these thresholds, and we reserve the right to retroactively cancel any automated order that violates our community standards.
• The Interactive Postcard & UGC License: Our premium packaging includes an interactive "Blank Beacon" postcard intended for personal reflection and social sharing. If you write on your postcard, upload design files, or share images publicly using the hashtag #HelloFellow or tag our official brand accounts, you grant Hello Fellow Tees a non-exclusive, royalty-free, worldwide license to use, repost, and display your image, text, and likeness for marketing and promotional purposes.
• Prohibited Content: You are strictly forbidden from inputting text or uploading images that are defamatory, hateful, obscene, threatening, or violate third-party intellectual property or copyrights.

4. Shipping, Fulfillment, and Third-Party Contracts

• Fulfillment: Hello Fellow Tees operates on a premium, print-on-demand fulfillment model. Processing and manufacturing windows are distinct from shipping transit windows. Free standard shipping applies to all orders shipped within North America. International shipping outside North America is charged at a flat rate of $12.49 USD.
• Shipping Estimates: While North American standard shipping is absorbed into our retail pricing, all delivery timelines are estimates provided by third-party carriers and are never legally guaranteed.
• Risk of Loss: All physical items purchased are made pursuant to a shipment contract. Legal title passes to you once the item is handed over to our shipping carrier.

5. International Customs, Duties, and Taxes (US-Canada Cross-Border Shipping)

• Import Fees: For shipments crossing international borders (including shipments between the United States and Canada), the buyer acts as the importer of record.
• Customer Responsibility: You are solely responsible for any and all customs duties, import taxes, brokerage fees, and local VAT or sales taxes levied by US Customs and Border Protection or the Canada Border Services Agency. These extra charges are collected by the carrier at delivery and are not included in our base pricing or flat-rate international shipping.
• Delays & Refusals: We are not responsible for delivery delays caused by international customs clearance procedures. If a shipment is refused by the customer due to unexpected customs fees, original shipping costs will not be refunded.

6. Quality Guarantee & Return Policy

At Hello Fellow Tees, every garment is custom-printed on demand specifically for you when ordered. Because we operate as a boutique print-on-demand business, all sales are final. We do not accept returns or exchanges for buyer's remorse, sizing choices, or user typos.

30-Day Replacement Promise: Your tee is made to spark a connection, and we care deeply about getting it right. If your order arrives damaged, misprinted, defective, or isn’t what you ordered, send us photo proof within 30 days of delivery. We will send a replacement at no cost, shipping included, so you can get back to making someone feel a little less like a stranger.

7. Intellectual Property Protection

• Proprietary Designs: The "Beacon" aesthetic, custom "Defined Fellowship" typographic hierarchy (featuring the exact 50% scale height variation of the word "fellow"), 3D sticker textures, and postcard artwork are the exclusive intellectual property of Hello Fellow Tees.
• No Replication: You are strictly prohibited from copying, reproducing, selling, or counterfeiting any portion of our apparel, graphics, software interfaces, or brand messaging without express, written permission.

8. Governing Law

These Terms and Conditions and any separate agreements whereby we provide you products or services shall be governed by, construed, and enforced in accordance with the laws of the Province of New Brunswick, Canada, and the federal laws of Canada applicable therein. Any legal action, dispute, or claim arising out of your purchase must be filed exclusively in a court of competent jurisdiction located in Moncton, New Brunswick, Canada.

9. Absolute Limitation of Liability & Behavior Disclaimer

• As-Is Basis: All premium apparel, Customily configuration spaces, and interactive materials are provided on an "as-is" and "as-available" basis.
• Disclaimer of Real-World Outcomes: While our brand mission is to foster community and human connection, Hello Fellow Tees is an apparel brand, not a mental health or safety service.
• Total Indemnity for Drama and Conflict: We assume absolutely zero liability for any physical injury, psychological harm, social conflict, verbal altercations, personal drama, or safety incidents that result from you wearing our shirts, displaying our designs, or interacting with strangers using the "Hello My Name Is" sticker concept. You wear this apparel and engage in public interactions entirely at your own risk.
• Damage Cap: In no event shall Hello Fellow Tees, its owners, directors, or suppliers be liable for any direct, indirect, incidental, or consequential damages. Our maximum total liability to you for any claim whatsoever shall not exceed the exact dollar amount ($38.00 USD / $52.06 CAD) paid for the specific shirt in question.

10. Territorial Clauses & Regional Disclaimers

The terms of this Section 10 apply specifically to users and buyers residing in the designated jurisdictions below. To the extent any provision of this Section conflicts with the general terms above, this Section shall govern for residents of that jurisdiction.

10.1 United States Requirements

• ⚠️ California Proposition 65 Notice:
  • Warning: Apparel products, including screen prints, inks, and custom heat-transfer labels, may contain trace amounts of chemicals known to the State of California to cause cancer, birth defects, or other reproductive harm.
  • By purchasing from Hello Fellow Tees, residents of California acknowledge that they have been provided with this clear and reasonable warning prior to purchase in compliance with the California Safe Drinking Water and Toxic Enforcement Act of 1986.
  • Technical Material Specification & Safety Profile: We fulfill our premium garments utilizing the AS Colour 5001T mid-heavyweight silhouette (5.3 oz/yd² / 180 gsm). This textile is engineered from 100% combed cotton, structurally reinforced with 28-singles yarn diameter configuration and side-seamed construction to maximize surface uniformity and structural integrity. The raw textile blank is inherently non-hazardous, hypoallergenic, biologically inert, and ethically manufactured under strict social responsibility protocols, adhering to international environmental and safety certifications. This regulatory Proposition 65 warning is triggered strictly as a proactive legal measure due to trace fixatives, aqueous-based polymers, or heat-curing agents standard across industrial third-party textile printing and digital graphic deposition processes.
• California Consumer Privacy Act (CCPA) / California Privacy Rights Act (CPRA): If you are a resident of California, you retain specific rights regarding the collection, deletion, and digital tracking of your personal information through our Meta ad pixels. Please review our Privacy Policy below to exercise your "Do Not Sell or Share My Personal Information" rights.
• FTC Textile Act Compliance: In accordance with the Federal Trade Commission, our clothing labels provide accurate disclosures of country of origin and fabric components (100% combed cotton). Print-on-demand fulfillment locations may cause variance in final assembly tracking; country of origin is strictly declared on each individual physical garment label.
• New Jersey Truth-in-Consumer Contract, Warranty and Notice Act (TCCWNA): In accordance with New Jersey law, the limitations of liability outlined in Section 9 of these Terms do not exclude or limit liability for intentional torts, willful misconduct, or gross negligence within the State of New Jersey.

10.2 Canadian Requirements

• Statutory Rights Reservation: Some provinces (including but not limited to Ontario, British Columbia, Alberta, and Quebec) do not allow the total exclusion or limitation of certain implied statutory warranties or conditions. If you reside in these provinces, the exclusions in Section 9 may not fully apply to you, and you retain all legal consumer rights that cannot be waived by contract.
• Quebec Language & Consumer Protection (Loi sur la protection du consommateur):
  • Language of Contract: The parties hereto explicitly acknowledge that they require this agreement, all associated purchase pages, and digital invoices to be drafted in the English language. Les parties aux présentes reconnaissent expressément qu'elles ont exigé que cette convention ainsi que tous les documents y afférents soient rédigés en langue anglaise.
  • Website & Interface Restrictions: In compliance with Quebec's Charter of the French Language (Bill 96), if you are purchasing from within the province of Quebec, you acknowledge that a French version of our product specifications, marketing communications, and checkout steps is available to you.
  • Warranty Restrictions: Section 9’s absolute limitation of liability is amended for Quebec consumers to comply with local public order laws; we do not disclaim liability for our own intentional or gross faults.
• Canadian Anti-Spam Legislation (CASL): By opting into our newsletter or submitting your email at checkout, Canadian residents will only receive commercial electronic messages (marketing emails) if explicit or implied consent is maintained under CASL guidelines. You may opt out instantly at any time.

11. Customily Software Usage, Content Standards & Final Sale Terms

• Acceptable Use & Conduct: The Customily personalisation engine must be used strictly for its intended purpose of creating respectful, personal, and lawful customized apparel. You explicitly agree that you will not use our Customily design interface to generate, render, or submit any content that is hateful, threatening, abusive, harassing, defamatory, obscene, or discriminatory against any individual or protected group.
• Zero Tolerance for Harmful Content: We reserve the right to immediately cancel, block, and refund any order featuring custom text or graphics intended to mock, dox, intimidate, bully, or incite violence or public drama. Using our interactive platform to create malicious or harmful shirts will result in a permanent ban from using our services.
• Automated Production Rights: In alignment with standard industry practices for automated custom printing, Hello Fellow Tees does not pre-screen or manually proof individual text layouts before production. Because customization is fully automated via Customily, you grant us a temporary, non-exclusive license to process and reproduce your inputted text and uploaded files solely to print and fulfill your physical order.
• Intellectual Property & Licensing Indemnity: By submitting or typing content via Customily, you warrant that you own or have the explicit legal right, license, or permission to use all text, inside jokes, phrases, and uploaded assets. You agree to fully indemnify and hold harmless Hello Fellow Tees, our printers, and our software partners from any third-party claims, trademark infringements, or legal costs arising out of your customized product creation.
• Strict Final Sale Policy: Because personalized garments are manufactured on-demand using unique user specifications, all custom sales are final. Hello Fellow Tees handles no inventory for custom variants and cannot accept returns, modifications, or cancellations once an order is submitted. This does not limit the 30-day quality replacement coverage described in Section 6.
• User-Generated Typographical & Layout Errors: You are entirely responsible for auditing your design, text, and layout choices within the customisation workspace before finalizing your purchase. We assume zero liability and will grant no refunds, store credits, or free replacements for customer mistakes. This includes, but is not limited to: grammatical errors, capitalization choices, punctuation omissions, misspelled words, text appearing smaller or larger than you expected, or layout positioning choices submitted via Customily.
• Manufacturing Defects Exception: Quality replacement coverage applies if a tee arrives damaged, misprinted, defective, or isn’t what you ordered. Send us a photo within 30 days of delivery. We’ll send a replacement at no cost, shipping included.

PART II: PRIVACY POLICY & META ADS COOKIE POLICY

Hello Fellow Tees is committed to protecting your data privacy. This policy outlines how we track, process, and manage your personal information.

1. Data Collection via the Meta Ads Pixel

We utilize the Meta Ads Tracking Pixel (Facebook/Instagram) on our storefront to help us optimize our 30-day Meta launch strategy, locate our target demographic, and track online conversions.

• What is Collected: The Meta Pixel places a small text file called a cookie into your internet browser. This cookie collects and shares data regarding your behavioral interactions on our site, including page views, items added to carts, and completed purchase checkouts.
• Meta Lead Ads & Data Integration: If you interact with our advertisements directly within Meta platforms, your public profile variables, location metrics, and voluntary email submissions are processed securely to improve your personalized ad relevance.

2. How We Use Pixel Data

• To run optimized retargeting campaigns targeting users who abandon their shopping carts.
• To audit, optimize, and build lookalike marketing audiences.
• To measure total Return on Ad Spend (ROAS) and monitor general marketing performance.

3. Cookie Management & Consumer Opt-Out Rights

We do not sell your personal data to third parties. If you do not want your behavioral data processed by Meta tracking infrastructure, you can control your preferences through the following channels:
